Voting Rules

These are the Voting Rules (the “Voting Rules”) governing voting relating to specific promotions (“Promotions”) offered and/or administered by Viacom Media Networks, a division of Viacom International Inc. on the Internet websites, applications or other interactive services (“Site”) that include an authorized link (directly, through the Promotion Terms (as defined below) or through the Terms of Use for such Sites) to these Voting Rules. The Promotions may have additional terms, such as the rules governing that specific Promotion (“Promotion Terms”) (for example, contest rules, sweepstakes rules or requirements set forth in calls to actions) which will be posted or otherwise made available to you and, for purposes of each such Promotion, these Voting Rules will be deemed incorporated into and form a part of the Promotion Terms.

If there are any inconsistencies between the provisions of the Promotion Terms and the terms of these Voting Rules, the provisions of the Promotion Terms shall govern.

1. ELIGIBILITY

Unless otherwise specified in the Promotion Terms, at the time of voting, voter must be a legal resident of the fifty (50) United States or the District of Columbia, 13 years of age or older and cannot be an employee, agent or representative of Viacom International Inc. the ("VII”), or any of its parent, affiliate or related companies.

2. HOW TO VOTE

Submit your vote in accordance with the applicable Promotion Terms which may include instructions on how to vote online, via wireless device or via one or more social media platforms.

Votes will only be counted if submitted in accordance with the applicable Promotion Terms and within the specified time period(s).

Unless otherwise specified in the Promotion Terms, you can vote as often as you like within the applicable Voting Period; however the use of any device, process or mechanism to automate votes is strictly prohibited.

3. VOTING VIA SOCIAL MEDIA

The Promotion Terms may provide the option to submit a vote via one or more social media platforms. Typically, you will be required to sign into your applicable social media platform account and submit your vote using one or more specified hashtags or taking another action permitted by the social media platform (e.g., Likes) that will correspond to your particular voting choice (for example, “Likes” that will correspond to your particular voting choice. Hashtags or any other actions will be typically be announced or specified in the Promotion Terms.

The social media account that you use to place a vote must have the account settings set to "unprotected" or "public" in order for VII to receive your vote. You must have an active account with the social media platform that you use to place a vote and you must comply with that platform’s applicable terms of service.

To vote using a mobile device, you may be required to use a mobile device capable of taking photos /videos and accessing/utilizing the applicable service(s).

Registration for certain social media platforms (for example, Instagram, Vine, etc.) requires downloading the free application to your mobile device and following the on-screen instructions to create a new account. Certain apps may not available for all devices and/or the features of a particular app may vary from device to device.

Online votes may be subject to standard internet connection fees.

Data rates may apply to votes submitted via a wireless device as provided in your wireless service rate plan. (Please contact your participating wireless carrier for pricing plans and details).

PLEASE NOTE THAT ANY AND ALL SUBMISSIONS AND METADATA SUBMITTED FOR PROMOTIONS MAY BE PUBLICLY VIEWABLE. IN ADDITION, PARTICIPANTS ACKNOWLEDGE THAT THEIR POSTS MAY BE RETWEETED OR REPOSTED BY THE PUBLIC OR OPEN TO PUBLIC COMMENTARY, FOR WHICH VII SHALL NOT BE LIABLE.

Use of any device to automate a vote is prohibited, including, but not limited to, software-generated, robotic, programmed, script, macro or other automated votes. VII reserves the right at its sole discretion to disqualify any individual it suspects or finds: (a) to have used a software-generated, robotic, programmed, script, macro or other automated online or text message vote; (b) to have tampered with the voting process; (c) to be acting in violation of these Voting Rules; or (d) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

4. DETERMINATION OF WINNERS.

Unless otherwise specified in the Promotion Terms, the total number of votes submitted during a voting period will be tabulated by VII; leaderboards do not necessarily reflect the most current status nor who shall be the winner of such category and the "Nominee" with the most votes in its applicable category, as determined by VII, will be declared the winner of such category. If, for any reason, a voting process is interrupted for any reason, is found to have been tampered with in any way, or for any other reason that VII believes in its sole discretion to be reasonably necessary, VII reserves the right to select the winner(s) at its discretion and may take into consideration the number of votes received by a Nominee up until the time of the interruption or cancelation of the voting process.

5. GENERAL TERMS

You participate in the voting process at your own risk. VII, the companies that provide the applicable social media platforms included in a voting process, the Promotion’s sponsors, and their respective parent companies, affiliated companies, related companies, sponsors, subsidiaries and advertising agencies, and any entity associated with this voting process ("Released Parties") are not responsible for and shall not be liable for: (a) difficulty accessing the internet; (b) errors in transmission; (c) service outage or delays or for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of any technical problems or traffic congestion on the Internet or at any web site or combination thereof: (d) any incomplete, lost, late, delayed, misdirected or garbled votes or failure to receive votes; (e) injury or damage to participant’s or to any other person's computer or mobile phone related to or resulting from participating in, or downloading materials or software, or attempts to participate in or download materials or software related to the voting process or (f) failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems, cellular equipment towers, telephone systems or wireless services or other communications malfunctions. The Released Parties are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of the Released Parties that may cause the voting to be disrupted or corrupted; (ii) typographical or other errors in the printing, the offering or the administration of these Voting Rules or (iii) any errors in the announcement of potential winners.

Participants assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the voting opportunity described in these Voting Rules, and release the Released Parties and any party associated with the production or exhibition of this promotion, and their respective officers, directors, employees, shareholders, parents, subsidiaries and affiliates from any such claim or liability.

If, for any reason, any aspect of a voting process is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failures or disruption, 'Acts of God' or terrorist attacks, or any other causes beyond the control of VII which corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting process or for any reason VII deems necessary, VII reserves the right at its sole discretion to cancel, terminate, amend, modify, extend or suspend the voting process and reserves the right in its sole discretion to determine the winners.

By participating in a voting process, you agree to be bound by these Voting Rules, the Promotion Terms and the Terms of Use and Privacy Policy applicable to the Site. Failure to comply with the Voting Rules, the Promotion Terms and the Terms of Use and Privacy Policy applicable to the Site may result in a voter's disqualification solely at the discretion of VII. VII reserves the right to modify these Voting Rules at any time in its sole discretion.

All interpretations of these Voting Rules and the decisions of VII relating to the voting process are final.

These Voting Rules were last modified on the date indicated above and are effective immediately.
